“Nutra Organics - 25th Birthday Prize Promotion” (Promotion)

TERMS AND CONDITIONS

1. Information on how to enter the “Nutra Organics-25th Birthday Prize Promotion” (Promotion), along with information about the Major Prize and Instant Win Prizes form part of these Terms and Conditions.


2. When you participate in this Promotion, you are deemed to have accepted these Terms and Conditions and the Promoter’s privacy policy located at https://nutraorganics.com.au/pages/privacy-policy 


3. Entries relating to the Promotion must comply with these Terms and Conditions to be valid.


4. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Promotion, these Terms and Conditions will prevail.

     

    Promotion 

    5. This Promotion consists of eligibility for entrants to:

    a. enter into the Major Prize Draw to win a once-off cash prize of AUD $25,000 (the Major Prize); and
    b. win one of 1000 Instant Win Prizes (Instant Win Prizes) by spinning the Instant Prize Wheel.
    6. More information on the prizes generally, the Major Prize Draw and the Instant Win Prize Wheel are contained under the headings ‘Prizes’, ‘Major Prize’ and ‘Instant Win Prizes’.
    7. The Promoter of the Promotion is Nutra Organics Pty Ltd ABN 16 142 009 836 of 2/2 Kite Crescent South Murwillumbah NSW 2484. To contact the Promoter please phone (02) 6672 4798.

    Promotional Period 

    8. The Promotion opens on, and the Promoter will receive entries into the Promotion from 14 August 2023 at 8AM AEDT.  The Promotion will close, and the Promoter will stop receiving entries into the Promotion, by 8AM AEDT on 14 December 2023 (Promotional Period). 
    9. (Entry through Promoter Online Store) Notwithstanding clause 6, where entrants enter the Promotion by purchasing an Eligible Product through the Promoter Online Store, the entrant must make that purchase (which, upon receipt of the purchase, becomes an Order) before 8AM AEDT on 30 November 2023 and subsequently submit an entry form online before 8AM 14 December 2023 in accordance with clause 9. 
    10. (Entry through Participating Retailer) Where entrants wish to qualify to enter into the Promotion by purchasing an Eligible Product through a Participating Retailer, the entrant must make that purchase (which, upon receipt of the purchase, becomes an Order) before 8AM AEDT on 14 December 2023 and subsequently submit an entry form online before 8AM 14 December 2023 in accordance with clause 9.
    11. To be clear, even if entrants make an eligible Order, that entrant must complete and submit the online entry form into the Promotion before the Promotion close date and time to be valid.  That is, all entrants must submit any entries before 8AM AEDT on 14 December 2023. 

    Eligibility to enter

    12. Entry into the Promotion is only open to individuals who satisfy the eligibility requirements (Eligibility Requirements) contained in the below clause 11.

    a. To make a valid entry into the Promotion, all entrants must:
    b. be over the age of 18; 
    c. be a resident of Australia or New Zealand;
    d. not be an employee or immediate family member of the Promoter or the Promoter’s associated companies and agencies. In this clause “immediate family” includes the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin;
    e. purchase an Eligible Product within times specified in clauses 6 - 9  and obtain a valid receipt of that purchase. Once both steps are taken, the entrant is deemed to have made an Order; 
    f. to enter into both the Major Prize Draw and spin the Instant Win Prize Wheel, complete and submit a valid entry form in accordance with the process laid out in clauses 15 - 38 (‘How to Enter’) before the end of the Promotional Period;
    g. to spin the Instant Win Prize Wheel, wait until the automatically generated Instant Prize Wheel has spun and confirmed whether the entrant has won an Instant Win Prize or not. 

    Eligible Products and Orders

    13. For the purposes of these Terms and Conditions, an Eligible Product is any full size Nutra Organics Australia product (sachets, individual bars, and samples are excluded)

    a. purchased from a Participating Retailer before 30 November 2023; or
    b. purchased through the Promoter Online Store within the Promotional Period.
    14. A Participating Retailer will be any retailer who promotes the Promotion within their store and provides customers the opportunity to enter into the Promotion by scanning a QR code in store.
    15.  An entrant will be taken to have made an Order where:
    a.  the entrant purchases one or more Eligible Products in one transaction; and
    b. the entrant obtains a valid receipt of that transaction, whether in person when making a purchase from a Participating Retailer or from the Promoter when making an online purchase through the Promoter Online Store. 

     

    How to enter

    16. Only entrants who make an Eligible Entry are entitled to enter the Major Prize Draw or spin the Instant Win Prize Wheel and win the Major Prize or an Instant Win Prize.

    17. For the purposes of this clause, an entrant will make an Eligible Entry where they purchase an Eligible Product within the required promotional times set out in these Terms and Conditions, obtain a receipt for upload and meet the Eligibility Requirements.  

    18. To meet the Eligibility Requirements, and therefore make an Eligible Entry, each entrant must follow the entry procedure laid out in clauses 18 to 38 before the end of the Promotional Period.


    How to enter – when entering via a bricks & mortar retailer

    19. If an entrant would like to enter the Promotion by purchasing an Eligible Product from a Participating Retailer they must: 

    a. Purchase an Eligible Product within the required timeframe from a Participating Retailer and obtain a receipt of that purchase. For clarity, each transaction an entrant makes encompassing one, or more than one, Eligible Product will be treated as one Order (Order). Entrants are eligible for one entry into the Major Prize Draw and one spin of the Instant Win Prize Wheel for every Order they make within the Promotional Period;
    b. After making an Order, scan the QR code located on the promotional posters located in the Participating Retailer’s store. This QR code will direct entrants to an online entry form on the Promoter Website;
    c. Fully complete all required items on the entry form posted on the Promoter Website at https://nutraorganics.com.au/pages/25k-giveaway. To complete the entry form, entrants must input personal information such as their full name, a valid email address and contact phone number. Entrants must also upload their Order receipt. If an entry form is missing any required information, the entry will be invalid; and
    d. Before the expiry of the Promotional Period, complete and physically submit the fully completed online entry form by choosing ‘complete entry’ (or a similarly worded button).

    20. All entrants who successfully complete and submit a valid entry form will:

    a. automatically go into the Major Prize Draw to win the Major Prize; and
    b. have an automatically generated Instant Win Prize Wheel appear on their device screens.
    21. To successfully spin the Instant Win Prize Wheel, entrants must allow the Instant Win Prize Wheel to automatically spin and wait for the Instant Win Prize Wheel to settle on an Instant Win Prize or otherwise not land on a prize at all. The spin will be complete when an entrant has the outcome of their spin notified to them on their device screens.
    22. Where an entrant refreshes their webpage, closes out of the relevant webpage, loses internet connection or otherwise does not allow the Instant Win Prize Wheel spin to complete, the entrant is deemed to have forfeited their Instant Win Prize Wheel spin and any associated prize. 

    How to enter – when entering via the Promoter Website 

    23. If an entrant would like to enter the Promotion by purchasing an Eligible Product from the Promoter Online Store they must: 

    a. Purchase an Eligible Product within the required timeframe from the Promoter Online Store directly and obtain a receipt of that purchase. For clarity, each transaction an entrant makes encompassing one, or more than one, Eligible Product will be treated as one Order (Order). Entrants are eligible for one entry into the Major Prize Draw and one spin of the Instant Win Prize Wheel for every Order they make within the Promotional Period;
    b. After making an Order, wait for that Order to arrive at their nominated postal address. The Order will include a golden ticket containing a QR code;
    c. Scan the QR code located on the golden ticket. This QR code will direct entrants to an online entry form on the Promoter Website;
    d. Fully complete all required items on the entry form posted on the Promoter Website at https://nutraorganics.com.au/pages/25k-giveaway. To complete the entry form, entrants must input personal information such as their full name, a valid email address and contact phone number. Entrants must also upload their Order receipt. If an entry form is missing any required information, the entry will be invalid; and
    e. Before the expiry of the Promotional Period, complete and physically submit the fully completed online entry form by choosing ‘complete entry’ (or a similarly worded button).

     

    24. All entrants who successful complete and submit a valid entry form will:

    a. automatically go into the Major Prize Draw to win the Major Prize; and
    b. have an automatically generated Instant Win Prize Wheel appear on their device screens.
    25. To successfully spin the Instant Win Prize Wheel, entrants must allow the Instant Win Prize Wheel to automatically spin and wait for the Instant Win Prize Wheel to settle on an Instant Win Prize or otherwise not land on a prize at all. The spin will be complete when an entrant has the outcome of their spin notified to them on their device screens.
    26. Where an entrant refreshes their webpage, closes out of the relevant webpage, loses internet connection before the Instant Win Prize Wheel completes a spin, or otherwise does not allow the Instant Win Prize Wheel spin to complete in any way, the entrant is deemed to have forfeited their Instant Win Prize Wheel spin and any associated prize.

    How to enter – additional terms 

    27. Any entrant’s spin of the Instant Win Prize Wheel will be separate from, and in addition to, entry into the Major Prize Draw. To be clear, even if an entrant wins an Instant Win Prize, they will still have a corresponding entry into the Major Prize Draw for every Order they make. 

    28. If an entrant has not won an Instant Win Prize, they will receive a $10 Nutra Organics discount code (Consolation Prize). The Consolation Prize is subject to the additional terms and conditions in Schedule 1 – Additional Terms and Conditions for Instant Win Prize.

    29. Entrants can enter the Promotion multiple times by making multiple corresponding Orders provided each entry separately complies with these Terms and Conditions.

    30. To be clear:

    a. entrants can make a total of one (1) entry into the Promotion per Order per person; and
    b. one (1) entry into the Promotion (by completing and submitting the online entry form) will include one entry into the Major Prize Draw and one spin of the Instant Win Prize Wheel.
    31. Multiple entries into the Promotion claiming the same Order as the basis for eligibility into the Promotion will be disqualified.
    32. Incomplete or indecipherable entries or entry forms will be deemed invalid.
    33. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
    34. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    35. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
    36. Each entrant warrants to the Promoter that each entry submitted does not infringe the rights of any third party.
    37. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.
    38. All entries become and remain the property of the Promoter and agencies associated with this promotion.
    39. The Promoter has the right to validate the entry details and purchase receipt of a Major Prize winner or Instant Win Prize winner before transferring a relevant prize. Invalid entries, particularly those that do not contain a legible purchase receipt for an Eligible Product will not be accepted and an entrant will not receive any prizes.

    How to Win – Prizes 

    40. The Prizes entrants can win in this Promotion are: 

    a. One Major Prize (1 total) which consists of a once-off cash payment of AUD $25,000, the details of which are contained under the heading ‘Major Prize’;
    b. 1000 Instant Win Prizes (maximum 1 per Order), the details of which are contained under the heading ‘Instant Win Prizes’; and
    c. A guaranteed Consolation Prize of an AUD $10 discount code, the terms of which are contained in Schedule 1. There is no limit on how many Consolation Prizes an entrant can receive, provided each entry to which the Consolation Prize relates is an Eligible Entry.

     

    41. The Major Prize and the Instant Win Prizes do not include any other costs associated with redeeming those prizes, except for complimentary shipping.

    42. The Instant Win Prizes are not transferrable and not redeemable for cash. The Major Prize is not transferrable.   

    43. All expenses other than those expressly referred to in these terms and conditions will be at the winner’s cost.


    Major Prize

    44. All entrants who make an Eligible Entry are automatically entitled to enter into the draw Major Prize Draw to win the Major Prize. 

    45. The Major Prize is 1 x AUD $25,000 cash payment to be transferred via Electronic Fund Transfer (EFT) to the winner’s nominated Australian bank account.

    46. The Major Prize is a once-off prize that is separate from the Instant Win Prizes. All entrants are automatically entered into the Major Prize Draw and eligible to win the Major Prize irrespective of whether they have won an Instant Win Prize or not. 


    Instant Win Prizes

    47. Provided entrants do not forfeit their opportunity to spin the Instant Prize Wheel, for example by closing out of the relevant webpage prematurely, each entrant will receive an opportunity to spin the Instant Win Prize Wheel after completing and submitting an Eligible Entry via the Promoter Website. 

    48. The Instant Win Prize Wheel will be an automatically generated prize wheel that appears on entrants’ screens after submitting an Eligible Entry. The Instant Win Prize Wheel is operated using a computerised random system based on random odds and via the provider App Hub, LLC trading as Viral Sweep.

    49. After an entrant completes and submits an entry form, the Instant Win Prize Wheel will appear on the screen and spin automatically. The Instant Win Prize Wheel will showcase all remaining Instant Win Prizes as it spins. Entrants must not refresh or close the page window while the wheel is spinning. No compensation will be payable if an entrant is unable to claim an Instant Win Prize because they refresh or otherwise close the window while the wheel is spinning.

    50. If an entrant has won an Instant Win Prize, the Instant Prize Wheel will land on that Instant Win Prize and display a message on screen that entrant will be contacted within 72 hours about their Instant Win Prize. If an entrant has not won an Instant Win Prize, a message will appear on the screen stating that they have not won an Instant Prize but are nonetheless still in the running to win the Major Prize in the Major Prize Draw. Entrants that have not won an Instant Win Prize will also automatically receive the Consolation Prize via an email to their nominated email address, provided their entry has been confirmed as an Eligible Entry. 

    51. Winners of the Instant Win Prize have 14 days to claim their prize after they have been contacted by Nutra Organics.

    53. The Instant Win Prizes are decided by random odds, with each entrant receiving an equal chance to win an Instant Win Prize.

    54. Additional terms and conditions applicable to the Instant Win Prizes are detailed in Schedule 1 – Additional Terms and Conditions for Instant Win . 

    55. The Instant Win Prizes are valued in Australian Dollars inclusive of GST (if any) as at 26 June 2023. The Promoter takes no responsibility for any variations in the value of an Instant Win Prize.

    56. Each Instant Win Prize is subject to each Partner Promoter’s respective terms and conditions applying to those Prizes.

    57. The Promoter is not responsible for any loss, damage or injury suffered by any winner arising from an Instant Win Prize.

    58. Any ancillary costs associated with redeeming the Prize are not included, however the prizes will include complementary delivery.

    59. Any unused balance of the Instant Win Prize will not be awarded as cash.

    60. The Instant Win Prizes are not transferrable or redeemable for cash. 


    Draw dates and times – Major Prize

    61. The Promotion is a game of chance. The Major Prize Draw will take place at 2/2 Kite Crescent, South Murwillumbah, NSW 2484 on Dec 18, 2023 at 8:00AM AEDT using random selection via via the provider App Hub, LLC trading as Viral Sweep. To comply with national gaming regulations and legislation, an independent scrutineer will oversee the conduct of the Major Prize draw and winner announcement.

    62. The first valid entry drawn in the Major Prize Draw will win the Major Prize.

    63. If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request.

    64. Winning the Major Prize is not contingent on entrants being present at the draw. 


    Draw dates and times – Instant Win Prize

    65. The Instant Win Prizes will be decided by automatic electronic draw system immediately upon entrants completing and submitting an Eligible Entry on the Promoter Website and allowing the Instant Win Prize Wheel to spin until settled on a prize or no prize. The Instant Win Prize Wheel spin will be deemed complete upon an entrant receiving a notice on screen that they have won a prize or not won a prize.

    66. An entrant will not be able to resubmit their entry if they forfeit their spin of the Instant Win Prize Wheel in accordance with clause 25.


    Winner notification and publication – Major Prize

    67. The Promoter will publish the details of the Major Prize winner (initial/s, last name, postcode and state) online on the Promoter Website (nutraorganics.com.au) and the Nutra Organics social media accounts from 18 December 2023.  

    68. The Promoter will contact and notify the winner of the Major Prize Draw via phone and email on 18 December 2023.

    69. The winner must respond to the Promoter’s calls or emails to claim the Major Prize and provide their nominated bank account details to facilitate the EFT transfer of the Major Prize by 5PM AEDT on Thursday 11 January 2024, failing which the Major Prize will be treated as unclaimed and redistributed via a redraw.

    70. The Promoter’s decision is final, and no correspondence will be entered into.


    Winner notification and publication - Instant Win Prizes 

    71. Each winner of an Instant Win Prize that is valued at over $250.00 will be published (initial/s, last name, postcode and state) on the Promoter Website and the Nutra Organics Australia social media accounts (being @nutraorganics on Instagram, @Nutra Organics on Facebook) from 14 September 2023 onwards, and within 30 days of winning an Instant Win Prize.

     

    Winner notification and publication – Redraws and Second Chance Draw

    72. Each winner drawn from the Second Chance Draw (run in accordance with clauses 72 to 76) of an Instant Win Prize valued at over $250.00 will be published online on the Promoter Website and the Nutra Organics social media accounts from 12 January 2024.

    73. The winner of a Major Prize Redraw will be published online on the Promoter Website and the Nutra Organics social media accounts from 12 January 2024.


    Unclaimed Prizes – Instant Win Prizes Second Chance Draw

    74. Any Instant Win Prize that is not won by the end of the Promotional Period or is not claimed by winners (where required) by 5pm AEDT 5 January 2024 will be distributed via a second chance draw (Second Chance Draw).

    75. All entrants with an Eligible Entry will be automatically entered into the Second Chance Draw, irrespective of whether they have previously won a prize in the Promotion. 

    76. The Second Draw will be held on Friday 12 January 2024 at 8:00AM AEDT at 2/2 Kite Crescent, South Murwillumbah, NSW 2484. In order to comply with national gaming regulations and legislation, an independent scrutineer will oversee the conduct of the Second Chance Draw and winner announcement should the total value of the prizes in this Second Chance Draw exceed AUD $10,000. 

    77. Any winners of an Instant Win Prize in the Second Chance Draw will be notified via phone call or email on 12 January 2024.  

    78. Subject to this Second Chance Draw, if for any reason a winner does not claim an Instant Win Prize by 30 January 2024, then the Prize will be treated as forfeited. 


    Major Prize – Redraw

    79. The Promoter will make reasonable efforts to identify and locate the Major Prize winner.

    80. The Major Prize must be claimed by 5pm AEDT 11 January 2024.

    81. In the event the winner does not claim the Major Prize, the Major Prize will be redrawn on Friday 12 January 2024 at 8:00AM AEDT at 2/2 Kite Crescent, South Murwillumbah, NSW 2484.  

    82. The winner of the Major Prize Redraw will be notified via phone and email on 12 January 2024.

    83. The winner of the Major Prize Redraw will be published on the Promoter Website (nutraorganics.com.au) and the Nutra Organics social media accounts from 12 January 2024.

    84. An independent scrutineer will oversee the conduct of the unclaimed Major Prize Redraw and winner announcement.

    85. The Promoter reserves the right during the Major Prize Redraw to draw reserve entries as reserve winners in the event the winner of the Major Prize in the Major Prize Redraw does not claim the Major Prize. In this circumstance, the Major Prize will be awarded to the first reserve winner with a 30 day claim period, failing which the Major Prize will be awarded to the second prize winner with a 30 day claim period and so on. 


    Instant Win Prize Substitution

    86. If any Instant Win Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the relevant Instant Win Prize with a prize to the equal value and/or specification as the original Instant Win prize, subject to any written directions from a regulatory authority.

    87. Instant Win Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 


    Publicity

    88. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner of any prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

     

    Personal Information – Privacy Statement 

    89. The Promoter will collect personal information ("PI") such as the entrant’s name, address, telephone number and email address in order to conduct the Promotion. The Promoter may, for this purpose, disclose such PI on its website, social media accounts, to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. 

    90. Entry is conditional on entrants providing this PI. If an entrant does not provide this PI, the Promoter will not be able to accept their entry as an Eligible Entry into the Promotion, or otherwise distribute any prize to them.

    91. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://nutraorganics.com.au/pages/privacy-policy. 

    92. If, at the time of entry, an entrant opts into receiving email marketing from the Promoter, the Promoter may use the entrant’s PI for promotional and marketing purposes, including sending electronic messages or telephoning the entrant.

    93. The Promoter Privacy Policy contains information about how entrants can complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. By submitting a Promotion entry, each entrant consents to the use of their PI for the purposes set out in these Terms and Conditions in accordance with the Promoter’s Privacy Policy and the Privacy Act 1988 (Cth).

    94. Eligible entrants may access, change or update their PI by emailing the Promoter on marketing@nutraorganics.com.au or by telephone at (02) 6672 4798 during office hours.


    Social media platforms 

    95. This Promotion may be advertised on Facebook, Instagram or TikTok.  

    96. Entrants:

    a. release Facebook, Instagram & TikTok from all claims based on, related to or arising from the Promotion;
    b. acknowledge and agree that this Promotion is in no way sponsored, endorsed, administered by or affiliated with Facebook, Instagram or TikTok. 

    Limitation of liability

    97. To the extent permitted by law, the total liability of the Promoter arising under or in connection with this document will be limited to the value of the Major Prize.

    98. The winners have rights under the Australian & New Zealand Consumer Law and other similar legislation which cannot be excluded. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act 2001 or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:

    a. the Promotion;
    b. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    c. theft, unauthorised access or third party interference;
    d. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    e. any variation in prize value to that stated in these Terms and Conditions;
    f. any tax liability incurred by a winner or entrant; or
    g. use of a prize.

     

    General conditions

    99. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

    a. to disqualify any entrant; or
    b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    100. Any cost associated with accessing the Promoter Website is the entrant’s responsibility and is dependent on the Internet service provider used. 

     

    Definitions

    101. In this document: 

    1. Consolation Prize means a Nutra Organics discount code to the value of AUD $10. 
    2. Eligible Product means any full size Nutra Organics Australia product (excluding sachets and single bars) an entrant:
      1. purchases from a Participating Retailer before 30 November 2023; or
      2. purchases through the Promoter Online Store within the Promotional Period.
    3. Instant Win Prize means any prize contained in the table under clause 49.
    4. Instant Win Prize Wheel means the randomised electronic draw system used to select at random the Instant Win Prizes and physically represented as a prize wheel. 
    5. Major Prize means a once-off cash payment of AUD $25,000. 
    6. Major Prize Draw means the draw used to randomly select the winner of the Major Prize Draw, to take place in accordance with clause 58 to clause 62.
    7. Major Prize Redraw means the draw used to randomly redraw a winner of the Major Prize where the original winner fails to claim the Major Prize within the timeframe stipulated in this document. 
    8. Non-Excludable Guarantees mean any statutory consumer guarantee under Australian or New Zealand law that cannot be contracted out of. 
    9. Order means where an entrant makes purchases and Eligible Product and obtains a transaction receipt as proof of purchase. 
    10. Participating Retailer means any bricks and mortar store that chooses to participate in the Promotion, promotes the Promotion within in store and provides a QR in store to enable customers to enter into the Promotion. 
    11. Promoter Online Store means nutraorganics.com.au.
    12. Promoter Website means nutraorganics.com.au.
    13. Promotion means this Nutra Organics-25th Birthday Prize Promotion in which entrants have the opportunity to win the Major Prize and Instant Win Prizes. 
    14. Promotional Period means 14 August 2023 to 14 December 2023.
    15. Second Chance Draw means the redraw used to distribute any unawarded or unclaimed Instant Win Prizes to be held in accordance with clause 72 to clause 76.
