TERMS AND CONDITIONS

  1. Information on how to enter the “Nutra Organics - Scratch & Win Promotion” and the prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

  2. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Promotion, these Terms and Conditions will prevail.

Competition period

  1. Entries into the Promotion open June 10, 2025, at 3PM AEST and close at 11.59 PM AEST on June 17, 2025 (“Promotional Period”). 

Eligibility to enter

  1. Entry into the Promotion is only open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):

The Promotion is open to all residents of Australia except employees and immediate families of the Promoter and their associated companies and agencies. Immediate family includes the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

Entry is only open to Australian residents aged 18 years or over.

How to enter

  1. To be eligible to enter, individuals must satisfy the Eligibility Requirements and undertake the below steps during the Promotional Period.

Entrants must: Purchase any product in the Nutra Organics range within the Promotional Period from www.nutraorganics.com.au to be automatically entered into the draw.

  1. A total of one (1) entry per order to the Promotion can be obtained.

  2. The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  3. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  4. The Promoter reserves the right to disqualify any entrant who tampers with the scratch and win process. Entrants who submit an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

  1.    The Prize must not be combined with any other voucher or offer.

  2. The Prize must be claimed by July 31, 2025.

  3. The Prize is not transferrable and not redeemable for cash. If the Promoter is unable to source a prize at the time the competition is drawn, a prize to the same value will be issued subject to relevant regulatory approval.

  4. Any ancillary costs associated with redeeming the Prize are not included. Any unused balance of the Prize will not be awarded as cash.

  5. All participants, including prize winners will receive a discount code. 

How Prizes Are Awarded

  1. Major prizes are randomly distributed among the 11,000 scratchies. Discount codes and Nutra Organics prizes are revealed instantly by scratching.

  2. Discount codes are single use only and cannot be combined with other offers, valid until 31st July 2025.

  3. Scratchie Allocation will go to the first 11,000 orders only — scratchies available while stocks last. One scratchie per order.

  4. Prizes can be claimed by following the directions on the scratch & win card. Scratch the panel on the front  to reveal the prize. If it is a discount code, enter the code at the checkout online at www.nutraorganics.com.au. If you won a major prize, take a photo of your winning card and email support@nutraorganics.com.au before July 31st to claim.

  5. The last name, initial of the first name and postcode of each winner of a prize which is over $250 will be published within 30 days of the close of the lottery online at www.nutraorganics.com.au

Unclaimed Prizes

  1. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the Prize will be forfeited. 

Personal Information

  1. The Promoter will collect personal information ("PI") such as the entrant’s name, address, telephone number and email in order to send any physical prizes. The Promoter may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://nutraorganics.com.au/pages/privacy-policy.  

Limitation of liability

  1. To the extent permitted by law, the total liability of the Promoter arising under or in connection with this document will be limited to the aggregate value of the Prize.

  2. The winners have rights under the Australian Consumer Law and other similar legislation which cannot be excluded. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  3. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of any or all of the athletes, experts or live match is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;  (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.

General conditions

  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  2. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
